After 1990's, the medical dispute has been social issues in our country. And the medical dispute would be a final solved by the judgement of a court same as other kinds of disputes. But a solution by the judgement of a court might cause not only a excessive, defense medical treatment by doctor, but also the cost disadvantage to the patient. Besides, it has a bad effect on confidence between the patient and physician. So it is need the alternative dispute resolution(ADR) for a rational solution of the medical dispute.
But, in a system or an organization for ADR, part is useless and part usefulness. For example, the mediation of medical judgment commission is useless, because of having not been the full-time organization and being lost all of the equity for leading of a government office. The other side, they are serviceable to solve in medical dispute that those are the mediation of civil mediation law, the settlement of a court, and the mediation of korea consumer dispute settlement commission. Nevertheless, those need other system's complementary cooperation.
For example, they essentiality are an activation of Medical Malpractice Insurance and an enactment of the Mediation Law of Medical Dispute. In the introduction of those systems, it is necessarily need to the independence organization of an accident research and appraisal, in oder to guarantee that a standard of compensation, equity, professional, and objectivity. Also, that be positively necessary an enactment of “A legislative bill for a precaution and relief of an accident of medical treatment”
