In this study, related to assembly and demonstration culture which isn't fully settled down in our society, through reviewing shift process of the Law on Assembly and Demonstration we examined periodical distinguishing legal-social characteristics from the past to the present, and showing major issues of the present Law on Assembly and Demonstration comparison with examples of foreign country we brought up desirable direction for improvement of the present Law on Assembly and Demonstration . Major issues of the present Law on Assembly and Demonstration which examined in this study are prohibition and restriction of assembly and demonstration(prohibition notice related to public order and competition of assembly place), the so-called ghost assembly and demonstration, assembly and demonstration participator’s mask wearing issue. Additionally, we examined restriction issue of nighttime assembly and demonstration, and policemen’s entrance issue into assembly and demonstration place belongs to those major issues as well. Consequently, the present law on assembly and demonstration should be revised with the direction for solving those legal problems.
