Incoterms® 2010 Rules are the regulations necessary for making a contract of sales of goods. When the parties to a contract make a contract of sale, the parties to the contract have to incorporate a rule of Incoterms® 2010 Rules in their contract of sales. In particular, when the parties to the contract intend to agree on the costs of checking operations, the obligation to package the goods and to mark on the packaging as stipulated in a rule under the Incoterms® 2010 Rules, it is important for the parties to know who has to incur these costs and obligations. Each rule of the Incoterms® 2010 rules deals with the checking, packaging, marking and the inspection of goods in articles A9/B9. These provisions are similar to the articles A9/B9 under Incoterms 2000 Rules. The purpose of this paper is, therefore, to analyze the clauses of checking, packaging, marking and the inspection of goods under articles A9 and B9 of the Incoterms® 2010 Rules and to point out the problems of the clauses needing utmost attention.
