Recently, the National Assembly is considering a revision to the Labor Union and Labor Relations Adjustment Act of Korea, which states that the court should set different liability for damages depending on the responsibilities and contributions of illegal actors in the event of damage caused by illegal collective bargaining or industrial action. The revision was proposed as an alternative to the so-called ‘Yellow Envelope Act’, which states that labor unions are not liable for damages even if they engage in illegal industrial activities. This amendment is contrary to the established legal principles regarding joint tort liability, joint and several liability, and non-performing joint and several liability. Considering that industrial action is carried out in the form of collective action, it is virtually impossible to individualize the responsibilities of union members or union officials who actively and led the illegal act according to the cause attributable or the contribution. From the same point of view, it is not right that the Supreme Court recently ruled that the liability for damages of union members who actively participated in illegal industrial acts can be individualized. It should be avoided to revise the previously established legal principles and existing precedents of the Supreme Court without sufficient legal grounds and public consensus. Comprehensive consideration of various stakeholders and in-depth discussions on anticipated problems should precede its implementation, taking into account practical issues that may arise.
