The contract for the International Sale of Goods in a International contract whereby seller transfers or agree to transfer the property in goods to the buyer for a money consideration. called the price. And international sale of goods in to transfer the goods and properties beyond tariff line by the sale contract of the parties residing in different jurisdiction.
Accordingly. it has been increased, owing to the growth of world economy, which results long distant transportation requiring inevitably a great deal of time and expense.
In the distant and perilous overseas transportation of goods, who should the megligence of either parties?
In other words, at which place or what time in the course of transportation should the responsibilities for losses of or damage to the goods be assumed to the seller or buyer reasonably? In this regard, I tried to study a comparative analysis approach to the risk structure and the risk in contract for the International Sale of Goods.
Namely, individuals studies will be made on each type of passing of the risk under UN convention contracts for the International Sale of Goods 1980, INCOTERS 2000, Uniform Commercial Code, Sale of Goods Act 1979.
In conclusion, a study will be made on new International Sale terms and responsibility or the risk of above terms. the necessity of further study on International Commercial Usages.
