Privatization of governmental functions and the widespread use of contract tool are global trend of our days. In analysing these public contracts related to privatization of governmental functions, it is important to balance between “efficiency of public administration” and “democratic-legal control to these contracts”.
The term “PPP (Public Private Partnership) contracts” can be applied in two dimensions. In narrow meaning, they refer to contracts only related to PFI (Private Finance Initiative). In a broad sense, they mean contracts related to cooperation between public and private institutions. Contracting-out can be included in the latter meaning of PPP contract.
PPP contract in a narrow sense is characterized by long-term, economic risk transfer to private sector, and therefore mutual trust between public and private institutions is especially important. Considering these features, the strict application of rules related to government procurement contract needs to be alleviated. However, some of the measures which government take in the process of implementing the contract can be challenged in administrative court.
Meanwhile, in PPP contract in a broad sense, contracting-out can be a tool for enhancing efficiency of public administration. But the boundary of contracting out of core function of government (eg. correction) should be carefully set up. In contacting-out core function of government, it is necessary not only to maintain some control by government but also to have a third party monitor the situation.
