The unit owners' association for management(UOAM) has the power of management of multi-unit building(MUB) by the Act of Ownership and Management of Multi-Unit Building(AOMMB). The conference of representative of resident of apartment building(CRRAB) does the business of management of building by the Housing Act. It matters which has the power of management when the MUB is apartment building. In principles, the power of management belongs to the UOAM which is composed of unit owner. Actually in case of apartment building, the CRRAB carries out the business of management, because the UOAM is hardly organized and the UOAM is more efficient entity for the management of apartment building. However the CRRAB has no power to carry out the business of management which belongs to the power of unit owners, because the CRRAB is not totally composed of units owners.
It is desirable to rearrange the AOMMB and Housing Act for the allocation of power of management of apartment building and to design a coherent rules. However it is difficult to design a coherent rules for the management, because all the apartment building is not multi-unit building and vice versa. Considering the UOAM is not efficient entity for the apartment building which is multi-unit building, the complete rules for the management of apartment building should be made separately from AOMMB.
