Victim-Offender-Mediation(VOM) is one of the practices of Restorative Justice which used to describe alternative ways of responding to crime. Mediation between the parties to a criminal act provides victims and offenders with a forum to mete out justice. In VOM, both sides have an opportunity to explain their behavior to each other. Victims can describe how they suffered, vent their anger, and condemn the conduct of the offender who harmed them. Offenders can explain what they did and why from their own perspective. Victims hear what happened directly their offender in his or her own words. Thus, victim can come to understand, without condoning, what the offender did. VOM with this form is accepted worldwide as a program which can resolve criminal complaints without a trial by having the victim and the offender enter into a negotiated agreement.
Criminal Mediation represents just one of a myriad of such a mediations that have spread throughout the criminal justice system for more than twenty-five years. In some jurisdiction, VOM explicitly became part of the special penal law regarding juvenile and adolescent defendants. VOM is evaluated nowadays as more efficient than the criminal justice system itself, and as more satisfactory for those directly involved.
However, many barriers still exist for jurisdictions wishing to adopt a criminal mediation program. Especially criminal mediation evokes both practical and controversial constitutional concerns about its place in the criminal justice system. Therefore this paper addresses and responds to principle of criminal liability and constitutional concerns regarding mediation's role within the criminal justice system. and criminal and they must be carefully considered before instituting such a program.
In this paper I emphasized on the one hand, that VOM fits to the classic task of criminal law, which is to prevent further offenses by influencing the offender and the public. It states on the other hand, that VOM is a reaction to criminal offence which restores peace between victim, offender and society, and can make additional criminal sanctions superfluous. A legal framework for VOM follows: Court judge and public prosecutors are entitled to divert officially 'suitable case' to a VOM-project, and eventually to dismiss fully the formal criminal procedure(special category of the legal offence) or a sanction can be mitigated(the other category of the legal offence) after a successful mediation has taken place. Although the key attribute of VOM is 'autonomy principle', but it should be also controlled criminal justice system, lest the offedners' liberty and victims' safety should be threated.
