I wished to grope the new control level about Incoterms' condition selection that is combined transportation condition and the problem when use of sea carriage condition searching being linked with Incoterms condition for damage withdrawal of damage that happen in Busan port's container terminal by typhoon 'Maimi' which occurred in 2003.
Therefore, this study wished to examine insurance problems about conditions in Incoterms in connection with typhoon that often attack over summer and fall of our country. And in the Incoterms, wished to examine the condition of optimum Incoterms and grasps definitely actual conditions in Incoterms trade terms.
According to this study, saw that following inconsistency is to use existent carriage by sea condition using containership. First, in occasion of container transport, too, it become Seller burden for goods demage that is carried in to container terminal if still use FOB condition, FAS condition and CFR condition. Second, because Seller makes insurance contracts, and because it covers all danger from export warehouse to destination warehouse, I think that no exist the problem since it covers demage of export warehouse for typhoon damage. Third, in that case of container transport, while is keeping within export area's container terminal in occasion of FCA or CPT trade term, goods damage by typhoon is covered Buyer burden in Incoterms. therefore, it is covered in the insurance by the Buyer. No problem is seen in these viewpoint.
Above these viewpoint, since it is trend import to the trade terms entrust to all responsibility about physical distribution with goods transport, it can be desirable that advance on DDP condition to warehouse gate of importer in export trader standpoint.
Therefore, in export trader standpoint, it estimates that need to respond thing which master know-how for insurance, entry, customs etc. that can satisfy importer's demand with full knowledge about DDP condition and is suitable in accident such as typhoon.
