As the volume of international trade is increasing and business environment becomes complex, chaotic and competitive, disputes in trade are also increasing and become more complex. The major purposes of this study are to investigate the relationship between the characteristics of firms and contracts and the experience of claim. and to suggest Korean trading companies and the relative institutes how to manage the claims efficiently and effectively.
The results of the study show on the following facts:
First, Small and medium companies are less knowhow about prevention and settlement of claim than large company. Second, credit investigation influences prevention and settlement of claim. Third, education experience of claim is correlated with experience of claim, but don't help to settle the claim. Fourth, although contract is very important in prevention and settlement of claim, but it is appeared that there is no relationship between the contract and prevention and settlement of claim.
Based on the results of my study, I suggest korean companies the following guidelines.
First, Small and medium companies should use the korean commercial arbitration Board to prevent and settle their claim.
Second, korean companies should investigate the counterparty's credit at least once per year.
Third, korean companies should improve their international negotiating power.
