The purpose of this article is to examine the Jurisdictions of the ICSID Arbitration and Practical Implications. The jurisdiction of the Centre shall extend to any legal dispute arising directly out of an investment, between a Contracting State and a national of another Contracting State, which the parties to the dispute consent in writing to submit to the Centre. When the parties have given their consent, no party may withdraw its consent unilaterally.
The ICSID Convention had to refer to investments in order to define the types of disputes that could be settled by ICSID tribunal. Thus, the term 'investment' appears in Article 25 of the Convention, which sets forth the jurisdictional requirements for a dispute before ICSID. Jurisdiction exists only over a legal dispute 'arising directly out of an investment; But the ICSID Convention uses the term 'investment', in Article 25, without providing a definition. Disputes about the existence or non-existence of an 'investment' will typically arise when the respondent in an ICSID case makes a jurisdictional objection at the beginning of the proceedings.
Expecially, I examined the relation between the basic date of ICSID Jurisdiction and Practical Implications. In the fields, the host state must be a party to the Convention on the date the proceeding are instituted. The same applies to the state of the investor's nationality: it must also be a party to the Convention by the time proceedings are instituted.
