There are five major issues in the capital punishment debate : the argument that capital punishment acts as a deterrent, the retribution argument, the arbitrariness argument, the danger of mistake argument, the incapacition argument.
Of course there are other less important issues such as cost efficiency argument, community protection argument, appeal to public opinion argument, crual and unusual argument, brutality argument etc.
The most serious sentence imposed by national and international criminal courts is the death penalty. Often thought no longer civilized penalty in the whole world, the death penalty is gaining popularity at an increasing rate. Over 70% of the korean people have an pro attitude toward the so cruel punishment. Yet for the state to take a life especially of murderers, such action must be theoretically and domatically justified. The justification and excuse of the death penalty had been hotly debated. Proponents argue that capital punishment plays key role as a deterrent for the individual as well as for other potential murderers.
Really many people accentuate that capital punishment is the only satisfactory retribution that society can gain for such a heinous act as premeditated murder. Opponents argue that such sentences are not effective for deterring murder. Sentences are imposed arbitrarily, often based on the wealth of the victim or murderers. Such a mistake justifies of the elimination of the death penalty. Finally they pointed out that all of the empirical on the subject failed to prove death penalty acts as a deterrent. Other minor issues must be examined.
