Enacted in 1966, and taking effect on July 5, 1967, the Freedom of Information Act opens vast numbers of “agency records”. FOIA was further amended by the Intelligence Authorization of 2003, effective as of November 27, 2002. Lastly, the FOIA was once again amended in 2007 with the passage of the OPEN Government Act of 2007. However, FOIA contains nine categories of exceptions to the requirement that agencies disclose their records. Therefore, there is much room for the Trade Secrets(Exemption 4) being interpreted arbitrarily by public agencies on the clause from their own angles. In regard to this, the courts of the United States have made constant efforts for establishing the adequate standards on the Trade Secrets.
In turn, In 1996, Korean government introduced Korean Freedom of Information Act to develop the right to know and to contribute the development of democracy in Korean society, but The act also has some vague and comprehensive definition and contents of Article 9 (Decision on Disclosure of Information), inter alia, No 7.
This thesis will analyze recent trends of decisions on FOIA Exemption 4; the relations between the Trade Secrets, commercial or financial information obtained from a person and privileged or confidential and step by step decision-making under Critical Mass on them. In conclusion, I think the Critical Mass(en banc) test - a distinction between voluntary and required information - needs to be even more clarified forward.
