This study aims to analyse legislative policies of Korean National Assembly and the Government, regarding their amendment bills of the Korean Criminal Code and special criminal laws. Korean Institute of Criminology has kept its role in providing expert consultation on every major amendment bills in the field of criminal justice, and has contributed to put social and political concerns on the issues of crime prevention into criminal legislation.
Bills proposed both by the members of National Assembly and government during the year of 2011 includes Amendment on the Criminal Code, Criminal Procedure Code, Special Act on the Punishment of Sexual Violence, Special Act on the Protection of Victims of Sex Crimes, and Special Act on the Protection of Children Against Sex Crimes. Major issues of legislative reform on criminal justice covers penal administration, community sentence, asset recovery, data protection, and due process.
This report points out that some amendment bills show their lack of consistency and effectiveness. Such reform may result more troubles to current system of criminal laws, which is being criticized for their inefficiency and complicatedness.
Thus, it concludes that more systematized and rationalized policies are required in the matter of legislation on crime prevention and criminal justice, with more effective and consistent criminal justice policy.
