Purpose ? The purpose of the paper is to show that we will need to check closely the exemption of an insurer on ship’s seaworthiness focus on the breach of warranty and a causation with insurance accidents.
Design/Methodology ? Data were collected from the related literature and researching precedents. The period of performance was from December, 2010 to February, 2011.
Findings ? A ship’s unseaworthiness applies to voyage insurance and time insurance differently as the breach of warranty.
Implications ? There is lack of understanding between an insurer and an insured about seaworthiness, and considering these contrary positions, rapidly changing trade environments, and considering these contrary positions, rapidly changing trade environments, and the recent judicial precedents that as for absence of seaworthiness, focus on a causation with insurance accidents, we will need to closely check the exemption of an insurer for the reason of seaworthiness.
