During the early half of the Joseon dynasty period, all properties of the parents were equally distributed to the children, in a fashion referred to as “Gyun‘bun( ).” Yet some of such properties 均分were not easy to be distributed in an ‘equal fashion,’ as it was impossible to split the parents’ house itself. So maintaining the ‘Gyun’bun’ principle was sometimes difficult. Then, in what fashion the children would have inherited that portion of the parents’ property?
There was in fact an exception to the ‘Gyun’bun’ principle, even during the early half of the Joseon dynasty period, and that was ‘the property’ which were reserved to be used or accessed for occasions of holding memorial services for the ancestors. Such properties were designated in the “Bongsa-jo(奉祀條)” category of the law. In 1427(9th year of king Sejong’s reign), all residences equipped with a ‘Family Shrine(Ga’myo, 家廟)’ were instructed by law to be inherited to the descendant designated to be in charge of the ancestral services(“Ju’je Ja’son, 主祭子孫”). Then what would have been the case of all the “Ib-myo Residences?” Would have they belonged to the Bongsa-jo category as well, and deemed as an exception from the ‘Gyun’bun’ principle? What would have been the relationship with the Ib-myo residences, and the general definition of a “Bongsa-jo property?”
In this article, with the questions raised above kept in mind, the Sajok figures’ inheritance practices of living residences are examined through the ‘Records of Dividing Properties’ of the 15th and 16th centuries. First, their ownerships of residences are examined, and then their inheritances of them.
