Since the labor law was promulgated in the People"s Republic of China in 1995, the related regulations, including Trade Union Act, Industrial Disaster Insurance Ordinance, Labor Contract Law, Labor Dispute Adjustment Arbitration Act, and Labor Contract Enforcement Ordinance, have been promulgated successively, and so have formed the legal system which regulates the labor relations in China. The purpose of these laws and regulations is not only to protect laborers" interests, but also to form the normative and harmonious relations of labor and management through protecting laborers and so promote the joint development of the staff and the firm and realize the win-win of both labor and management sides. It was very rare in the history of enactment in China that a law caused such a great controversy from the beginning of its enforcement. Thus, the purpose of this paper is to comment on Labor Agreement Law and related regulations primarily in the standpoint of employers and so enable employers to heighten the management level of labor relations and prevent labor disputes beforehand and construct the harmonious relations of labor and management as the Chinese Supreme People"s Court promulgated the interpretation of some problems related to applying laws to the trial of labor dispute accidents.
