This article is a comparative study of Current Domestic Laws and Housing Health and Safety Rating System of UK (HHSRS). Recently “Residential Basic Law” is conducted in Korea means dwelling is not an incidental dimension of life, but is a fundamental right of citizens, it reveals the direction of existing housing policy focussed expanding housing supply will be changed to housing welfare based on the quality of the housing. As Korea is in the initial phase of the “Residential Basic Law”, institutional framework to improve the quality of dwelling is urgently needed. UK, the leading country of minimum residential standard and the Decent Homes Standard, had applied HHSRS in the Housing Act revised 2004 is the system to assess the actual living environment of the maintenance level, not legal acts in construction time. HHSRS is the system for screening to find the minimum residential substandard household, using a risk assessment approach to grasp the condition of properties. And it is the system to prevent that accident not a follow up to the actual accident, it seemed effective to set the basis of the healthy housing. Therefore, this study was compared to the case of the UK as a previous study to give shape to the necessary institutional arrangements currently in Korea. The result of this study was as follows; The domestic law compared with the UK cases, There is some weak point in domestic laws such as certain important issues of dwelling field are absent. Although there are enough rules, but scattered. Described manner is too brief or professionally then it is difficult to understand for the general public.
