In old Roman Law, it is said that jurists distinguish ‘emptio rei speratae’ and ‘emtrio spei’ (Pomp. D.18,１,8pr.). The former is one of the origins of Juristic Act including condition in Japan, but Japanese Code Civil doesn’t admit the latter. This article treats the concept of aleatory contracts in Japan.
In Meiji era (1868- ), Japan forced to introduce the system of the modern Code by the influence of Western countries. At that time Japanese jurists confused the aleatory contract with gambling so that they didn’t put the general rules of aleatory contract and the rules of gambling, which the draft of Code Civil Japan treated valid, has once prescribed before they expired. Since then, Japan has no rules about aleatory contracts except some articles of the life annuity (Art. 689) and insurance contracts (Code Insurance). According to my research, Japanese jurists seemed to come to identify aleatory contract with gambling afterwards and they thinks these invalid. In brief, Japanese jurists think an aleatory contract to be invalid in general. However, I think that that opinion is wrong because all the insurance contracts should become invalid if such a way of thinking is right.
The actual profit of the aleatory contract is not limited to distinction with the aleatory contracts and the gambling. The standard to judge the effectiveness of the aleatory contract is different from that of other normal contracts. For example, this happened in the case art. 570, 572 Code Civil Japan about latent defects and art. 5 Code Insurance and so on.
