The purpose of this thesis is to investigate the soldier's responsibility by legal positivism and natural law. It is certain that the responsibility is most important values in the military. This is not a simple matter to be applied, because a state of soldier is unique position that is required a military discipline which are the most important values in the military. at the same time, moral values should be required. Thus, each soldier has not only the duty to follow military law but also the duty to act properly as a moral agent. This is, all soldier has both the responsibility of law and moral. However, the responsibility of law and moral do not always coincide. In some cases, there is a legitimate but immoral. In this cases that is a hard to determine the responsibility. To solve this problem, we should verify whether soldier's responsibility is valid even a legal positivism. For this, I shall criticize the legal positivism and reveals the limits of legal judgment. And then, I shall argue the justification of moral judgement by natural law. If we complete the task successfully, will be able to identify what a true concept of responsibility.
