In this paper, we examine student speech rights in contemporary Korea, a land inwhich there has been an upsurge in democratic aspirations in both society and educationduring recent decades. We first establish the reasons why freedom of expression isimportant in democratic societies and then consider how the special characteristics ofKorean schools might transform student free speech in Korean schools. From theanalysis, we suggest that the several characteristics of schools in the Korean settinghave mixed implications for student speech rights. Specifically, while the characteristicsof Korean schools give some reasons to protect student speech, they also show thatthere are strong reasons to limit it. Despite there being circumstances in which studentvoices might need to be controlled because of the needs of a school environment, thespecial environment of schools reminds us that schools must take student rightsseriously in order to fulfil their educational mission.
