Based upon the broadcasting and telecommunication convergence, new services such as IP TV, DMB, webcasting, video on demand(VOD), and podcasting are being offered. There are some issues in these new services. Those issues may be divided into two categories: the one is how to regulate those services; and the other is how copyright law applies to those services. This paper expects that the regulatory or systematic issues will be resolved as the Committee on the Broadcasting and Telecommunication Convergence works on those issues. It is, however, difficult to resolve copyright issues. Are some services such as IP TV or VoD broadcasting or electronic transmission under the Copyright Act? Under the Copyright Act, broadcasting is provided a different treatment from electronic transmission. This paper argues that copyright issues on the broadcasting and telecommunication convergence should be resolved taking copyright policy into consideration. Copyright policy aims, on the one hand, to protect the rights of authors and, on the other hand, to promote fair use of works in order to contribute to the improvement and development of culture.
