As a means of managing insurance proceeds, insurance claim rights trusts can be particularly helpful for individuals who are at risk of squandering large insurance proceeds received after the death of a beneficiary, such as minors and persons with disabilities. In other words, from their perspective, it can be beneficial to have the large insurance proceeds received after the death of the insured managed by a trustee with professional knowledge, such as an insurance company, and to receive regular trust income payments. As such, insurance claim rights trusts can be utilized for the purpose of contributing to the welfare of bereaved families.
From the consumer perspective, the insurance claim rights trust can positively impact both consumers and insurance companies by allowing a professional trustee to manage the insurance proceeds on behalf of beneficiaries who lack investment and management experience and knowledge, thereby ensuring stable payments of living expenses to beneficiaries. From the insurance industry perspective, it could serve as a new revenue source for insurance companies holding comprehensive property trust licenses. Therefore, it is necessary to review whether insurance companies must limit their trust operations to ancillary businesses under the current Insurance Business Act, or whether they can conduct trust-related businesses as subs/diary businesses. Through this review, it is necessary to examine whether insurance companies can perform trust-like functions within a certain scope by utilizing the subsidiary business system, and to explore ways to expand insurance companies’ participation in trust operations through the utilization of the subsidiary business system.
