Punishment is a social phenomenon. Therefore, we need to approach issues of punishment with sociological perspectives. This paper introduces and discusses influential authors who suggest insightful perspectives on punishment: Durkheim, Rusche and Kirschheimer, and Foucault. Durkheim stresses moral components of punishment and links the quantitative and qualitative differences in punishment to different types of solidarity. In Marxist perspective, Rushee and Kirschheimer argue that specific forms of punishment is determined by economic structure, specifically labor market situation. On the other hand, Foucault proposes a political analysis on punishment, emphasizing such concepts as power, knowledge, and body. And this paper finds a theoretical linkages between Foucault and Weber in terms of rationality in modem society. Each perspective profoundly contributes sociological studies of punishment by suggesting important theoretical framework. However, they seems to ignore the possibility of autonomous legal system or criminal justice system. Even though societal(moral), economic, and political elements can entail certain ways of punishment, the systems around punishment may establish their own operational autonomy which is more or less independent form other spheres of society.
