This paper examined the changes of provisions about freedom of speech in the Constitution of Korea, from provisional government in Shanghai to the several Republics of Korea that is originated from constitutional reforms.
The freedom of speech is the fundamental value and the most important purpose to pursue in the democratic society. Nevertheless, provisions relating to freedom of speech in the Constitution of Korea have been changed over time according to the will of the power.
To find out noticeable changes of provisions, six main areas have been examined. Those provisions is associated with ① the freedom of speech and the press, ② the rights of human dignity, ③ the communication privacy, ④ the protection of privacy, ⑤ the guaranteeing freedom and rights, and ⑥ the freedom of speech in the condition of martial law.
This paper focused on the changes in the ranges of the freedom of speech that is caused by modifying and deletion of constitutional provisions.
