In South Korea, structural reform of sports policy remained constrained by the elite sport-centered orientation of the Korean Sport & Olympic Committee (KSOC) and the Korean Paralympic Committee (KPC). To address this issue, this study reexamines the legal status of both organizations by focusing on the scope of their rights and obligations within the administrative legal framework. Specifically, it investigates the applicability of the concept of “entrusted private entities for public affairs” (gongmusutaksain) to the KSOC and KPC, analyzes the statutory basis and policy implications of such designation, and compares this framework with their current status as special corporations in order to suggest future governance directions.
The findings are as follows. First, an entrusted private entity for public affairs refers to a private individual or corporation that, based on explicit statutory authority, is entrusted by the state or a local government to perform public administrative functions. The requirements for such designation include: (1) the existence of clear statutory authorization, (2) the public and administrative nature of the entrusted duties, (3) the capacity to exercise authority as an administrative actor, and (4) the assumption of administrative legal responsibility. Second, an examination of the National Sports Promotion Act and the Administrative Procedures Act indicates that both the KSOC and KPC satisfy these criteria. The anticipated policy effects include: (1) clarification of administrative authority and enhancement of legal stability, (2) strengthened accountability and transparency, (3) improved efficiency in policy implementation, and (4) enhanced cooperative governance between the state and civil society. Third, as a future development strategy, the study proposes a “hybrid system.” Specific policy recommendations include revising the National Sports Promotion Act, establishing detailed regulations and operational guidelines to reduce legal ambiguity, ensuring organizational autonomy in non-core functions, and creating a permanent consultative body between the government and the two organizations.
