This paper examines the legal and ethical challenges of artificial intelligence (AI) in international trade and explores regulatory interoperability between international digital trade rules and domestic legal systems. Through literature review and comparative legal analysis, it investigates national laws and international frameworks, including APEC CBPR, CPTPP, DEPA, and UNCITRAL model laws. The findings identify key issues concerning cross-border data flows, intellectual property, algorithmic fairness, AI agent liability, and cybersecurity.
The study highlights the need for trustworthy data governance, risk-based regulation, transparency, and clear responsibility allocation. It emphasizes regulatory interoperability over uniform harmonization to reduce regulatory uncertainty, support SMEs, and promote sustainable global digital trade.
