This study critically examines the policy debate surrounding the mandatory registration of residential lease contracts in South Korea as a means of preventing Jeonse fraud. It also proposes an alternative strategy that emphasizes activating lease registration. The contraction of the rental housing market following multiple Jeonse fraud incidents is interpreted not just as a response to increased risk but as a market disappearance phenomenon driven by information asymmetry and declining institutional trust. This study determined that comprehensive mandates may result in regressive protection effects and regulatory avoidance, which could potentially undermine tenant protection, when evaluating mandatory lease registration against four criteria: necessity, subsidiarity, equity, and enforceability. Furthermore, it advances an alternative policy approach that maintains existing tenant protection mechanisms while promoting the gradual diffusion of lease registration through local government support and incentive-based participation. By improving the informational environment of the rental housing market, this activation strategy aims to enhance tenants’ legal standing, reduce information asymmetry, and support the restoration of normal market functioning. The findings suggest that the activation of lease registration provides a realistic and institutionally feasible approach for Jeonse fraud prevention in the current policy context.
