As an alternative, arbitration has become very popular in the world. Arbitration is faster and less expensive than litigation in the courts. Judicial systems do not allow the parties to a dispute to choose their own judges. In contrast, arbitration offers the parties the unique opportunity to designate persons of their choice as arbitrators, provided they are independent. This enables the parties to have their disputes resolved by people who have specialized competence in the relevant field
An arbitration agreement could be an arbitration clause stipulated by the parties in their contract or a separate written agreement concluded by the parties to submit their dispute for arbitration. The arbitration agreement may be reached prior to or after the occurrence of disputes.
According to Article 16 of the Arbitration Law of PRC., a valid arbitration agreement. must contain the following 3 elements: (i) the intention to submit the dispute for arbitration; (ii) the matters for arbitration; (iii) the arbitration institute.
China International Economic and Trade Arbitration Commission (CIETAC) independently and impartially resolves, by means of arbitration, disputes arising from economic and trade transactions, contractual or non-contractual. As from October 1, 2000, CIETAC broadens its scope of jurisdiction to take cognizance of cases of different natures, whether international or domestic.
CIETAC takes cognizance of a case in accordance with an arbitration agreement reached by the parties to refer their dispute to CIETAC for arbitration and upon the written application by one of the parties.
Model arbitration clause recommended by ClETAC Any dispute arising from or in connection with this contract shall be submitted to China International Economic and Trade Arbitration Commission for arbitration which shall be conducted .in accordance with the Commission's arbitration rules in effect at the time of applying for .arbitration. The arbitral award is final and binding upon both parties.
"1958 New York Convention" became effective in China on April 22, 1987, which facilitates enforcement of CIETAC's awards in all contracting states.
A<?cording to Chinese law, if one party fails to comply with a CIETAC's award, the other party may apply for its enforcement to the intermediate people's court of the place where the party against whom the application for enforcement is made has his domicile or where his property is located.
