We have many opportunities to use restaurant, theatre, inn, hotel, and recreation ground, etc. in daily life. The Categories of these business belong to the tertiary industry, and are developed more various and bigger with a development of society and a transition of the propensity to consume(health care, use of leisure time, dilettante life etc.). These business are provided 「service trader for public」 in the Korean Commercial Code (in chapter of commercial transaction). The KCC divides liabilities of service trader into three parts (liability for hand baggage was deposited with service trader [Receptumhaftung], liability for hand baggage was not deposited, and liability for valuables of a customer), and it is an exception for provisions about deposit of civil code. But, in Germany (the same in France, Switzerland and Austria), these liabilities are limited to a hotel man and regulated in civil code. The service trader (caterer) means theatre, inn, restaurant and so forth, those deal in transaction by the equipments for the sake of a customer's gathering, come and go, and belongs to basic commercial transaction (KCC §46). Nowadays, the equipments of service trader are mechanized and bigger, but on the other hand, a possibility of danger of an accident or a crime in those place is high. So it is advocated that a contractual provision (such as duty to provide a customer with a safety equipment) and a special provision(such as liability of bodily injury damage of a customer [e.g. KCC §148] ) are necessary to safety of a customer and to compensation for a customer.
