Generally, Self-Determination is a fundamental right that a individual must decide on one's own matters and freely leads one's own life-sphere without meddling and infringing from the Power of society and nation.
It was the same as followings, researching for the background on the arising of this Self-Determination.
In the early 1980s, What is the human rights? What kind of the value has the human rights? What scope of the demands on the human rights we admit? and what scope of the human rights we enlarge to? These questions are arising from in the early 1980s. This demand on discussion for the fundamental concepts and value of the human rights. This present situation is caused by the social fluctuation, is spouting the various and newly rights and freedoms.
Recently, under this circumstances, the keyword is individualism, that is, the respect for personality. It is inquired into this individualism or the respect for personality in a sense of problem, situation and circumstances. Self-Determination theory is human beings for these human question, and has a tendency to philosophical and ideological aspect.
Therefore, returning to the individual of the starting point of the modernistic human rights, we are necessary to make a study of one of self-determination through the confirmity to the present circumstances in a point of individual point.
This thesis is a prelude to the systematic study of the self-determination, and will study to an outline of the korean constitutional meaning, authority, type and bounds in a basis of japanese theory of the self-determination. And it put off to the following opportunity that are systematic studying on the some Nation's theory, the analysis of constitution cases, the distinction of private autonomy and the distinction of private freedom of the self-determination.
