The development of personal computers and internet networking not only offer a lot of convenience to the normal life of human beings but also cause many unexpected legal problems. The issues on infringement of the copyright which the users of internet exchange or share MP3 files without permission from a copyright holder is one of them. Internet service providers or administrators of network on internet may play a certain role to infringe the copyright when they provides a useful network environment to exchange or share contents files among a number of users. Furthermore, it is not direct infringement of the copyrights that MP3 files exchange service is available through the P2P method. However the protection of the copyright is appeared because MP3 files exchange service acts as intermediary of the infringement of the copyrights. On the issue of copyright infringement of internet service providers, the concept of indirect infringement of copyright was accepted by the U.S. Court in the Napster case and Grokster case, and in Soribada case in the domestic Court, However, more cautious approach is needed to solve the problem because cow in private is permitted in the area of copyright law
