The replacement punishment of flogging, which replaced punishment on the body or freedom with that of flogging, was a distinct punishment system clearly differentiated from that of the Grand Ming [Criminal] Code which originated from the Law of Tang and was standardized in later times. Thus, it goes without saying that replacement punishment of flogging had major influence on the penal system of Goryeo which imported it as well as Song Empire which created it. Previous studies understood it as a punishment restricted to specific types of crimes. However, considering that 『Goryeosa』 already had replacement punishment of flogging in place and also provided for an elaborate system of converting the five forms of punishment into replacement punishment of flogging, it would be unreasonable to regard replacement punishment of flogging as a punishment system limited to specific types of crimes.
Meanwhile, replacement punishment of flogging, in the course of its application in Goryeo, took a form a little different from that of Song Dynasty. For example, certain differences from 『Songxingtong』 can be found in subtle areas such as provisions of subsequent measures regarding the convicts as well as in the size of punishment equipment, differentiation of punishment equipment, or number of flogging. Moreover, Goryeo applied replacement punishment of flogging to “death penalty” which had been excluded from replacement punishment of flogging, thereby developing the replacement punishment of flogging in its own distinct way.
