One of the more important issues facing current letter of credit practice is the effect of Non-documentary conditions. The recent non-documentary condition cases on the L/C transactions show that their method and skills become more and more intelligent and complicated. Non-documentary conditions practice defeat the underlying principle of the documentary credit itself and directly contradicts the wording of Articles 2, 4, and 5.
Despite of UCP 500's clear stipulation that non documentary condition should be disregarded, certain banks continue to issue documentary credits and amendments thereto which contain a non-documentary conditions. It is evident that such wrong practice is causing severe problems to all parties involved in documentary credit transactions. So, it will reduce the efficiency of documentary credit business.
The purpose of this article is to clarify how non-documentary conditions in letter of credit transactions should be interpreted and treated in letter of credit business based on recently, domestic courts' decisions to preserve the independence principle. I think surely that the non-documentary requirements are not inconsistent with the principle of party autonomy because the L/C transaction will operate efficiently and effectively only if the inference doctrine keeps intact. In the recent decision in relate to the non-documentary condition, domestic courts appear to be having interpreted narrowly UCP 500 Article 13(c). But these attempts are very dangerous to the letter of credit operation. Conclusively these conditions must be disregarded and treated them as if they were not stated for safeguard the independence principle.
