The development of E-commerce has come to demand an efficient resolution of E-commerce disputes, which recently have been increasing rapidly in number. Among various methods to solve such disputes, one of the most appropriate types is online mediation. This paper explores the conditions of online mediation, by examining various cases, and attempts to show problems and tasks related to online mediation services in South Korea.
In order to manage a successful online mediation institute, the government must play an appropriate role in the following aspects; independence/impartiality, transparency, availability, affordability, effectiveness, due process, oversight, a validation program and so on. Based on these essential conditions, the online mediation service offered by the E-commerce mediation committee in South Korea needs to be improved in the following ways.
First, it is desirable that they adopt an integrated system of dispute resolution, which includes online negotiation and arbitration, apart from the current function of online mediation. Second, they need to be able to mediate international disputes. In order to do this, they need to be affiliated with foreign online mediation institutes, and in mediating disputes involving foreigners, a translation service is a must. Third, the current trustmark program needs to be improved, so that it guarantees enterprise's participation in dispute mediation, and their observance of mediation results. Fourth, they need to carry out the function of preventing disputes, by submitting reform measures regarding pertinent institutions and policies, analyzing and notifying the types of damage cases, displaying the list of firms involved in disputes, and promoting aid for damages. Fifth, they need to be concerned with quicker customer service.
