Since reformation and opening china rapidly change labor relation in proportion to epoch-making economy with introduction socialistic market economy system. Owing to increase a private enterprise and foreign invested company change of labor relations and the frequency of labor dispute are one example. In spite of like this change of labor environment the labor law of china only preserve a frame of past old rules organization system, would not meet the demand of the labor spot change.
The trade union in china, even though as a social structure reflect a specific character of socialistic china, fulfil it' s function for the entrance on the chief object of collective labor relations, request fundamental change. Current labor law of china do not center it's rule on collective dispute action in trade union but centering around dispute action of individual laborer and even though ennumerate a labor dispute type, do not recognize the right to strike. In china labor dispute are understanded as a dispute about right and obligation on the interested both parties of labor relation.
Generally speaking the trade union in china do not take part in collective dispute. The reason of like this situation is that because many private enterprises and foreign invested company would not permit to constitute the trade union. So only laborers participate in dispute. Even if the trade union exist, the trade union can not receive a ask of dispute because labor law of china do not confer a right to strike on the trade union.
According to current law dispute settlement in china must be solved by the both parties negotiation. In cases persons concerned do not wish for negotiation or fail negotiation, persons concerned can make a petition for arbitration at labor dispute arbitration committee. On the one hand without pass by negotiation they can directly make a petition for arbitration. If they would not accept the arbitration, they can litigate at pea ple's court.
So we can understand that labor dispute settlement system in china consist of one negotiation and one justice system.
