The ratification of the European Constitutional Treaty, which was pursued to achieve democracy and transparency, and to improve the efficiency in the administration of the EU was denied by referendums in France and the Netherlands, which put the future of Europe in the midst of uncertainty. However, the Lisbon Treaty, which was signed in the European Council held in Lisbon in December of 2007, could overcome the uncertainty of the future of the EU. It is estimated that the treaty included most of the main elements of the rejected European Constitutional Treaty.
In practice, the European Constitutional Treaty contained the institutional reforms to strengthen ultranationalism as a main feature and defined the elements to be the symbol of the EU. Thus these factors provided the opposing forces a stick for the rejection to the European Constitutional Union.
However, the real reason for the opposition to the European Constitutional Union by France and the Netherlands came from the disorder caused by economic difficulties and the social instability of each country in the process of ratification rather than negative estimation of European Constitutional Treaty itself.
In conclusion, this paper is to analyze the main issues in the formation of European Constitutional Treaty and examine the factors that made the ratification of the European Constitutional Treaty be fail. Additionally the main features and the implications of the Lisbon treaty, which replaced the European Constitutional Treaty, will be examined.
