The Basic Law for Cultural Industry Promotion (BLCIP) aims to contribute to the improvement of the quality of people’s cultural lives, and the development of the national economy by prescribing requirements for the support and fostering of the cultural industry, thus laying the groundwork for the development of the cultural industry and the strengthening of its competitiveness. To meet these goals, legal regulations must have the function of letting the subjects of the cultural industry choose desirable activities and preventing them from choosing undesirable ones. The objective of this study is to examine whether the BLCIP well reflects the intent of legislation, by analyzing its incentive and regulatory systems.
Analysis of the BLCIP, its enforcement decrees and ordinances shows that the BLCIP works out various legal means for the purpose of promoting our cultural industry, using both support and regulation, but fails to keep pace with the changing industrial environment. Such a legal system may cause problems of over-incentive and under-regulation, against which countermeasures are sought in connection with the environment of broadcastingcommunication fusion, the relationship with copyright law, the level of fair trade and the absence of cultural industry statistics. As a result, the current BLCIP seems to lack when it comes to active institutional preparation for the quickly changing technical environment. In particular, it turns out to pay little attention the issue of copyright, which could be referred to as the property right, in that there are no countermeasures against the fusion of media. Furthermore, it seems necessary to lay out regulations on the fostering of a transaction environment for fair competition, which is as important as support for industry.
Indeed, while government-level support is an important means for industrial promotion, any complementary legal infrastructure should be elaborately constructed to allow the means of support to contribute to achieving the original policy objective
