The Convention Concerning the Protection of the World Cultural and Natural Heritage (the “Convention”) includes “It will do all it can do to this end, to the utmost of its own resources and …” (Article 4), which requires each country to take legislative and administrative measures voluntarily in order to carry out the obligations provided under such Convention.
Nonetheless, the Cultural Heritage Protection Act of Korea only maintains and manages the World Cultural and Natural Heritage in accordance with the provisions which covers the “statedesignated cultural heritage” and lacks any legislative action to fulfill the obligations under the Convention.
Therefore, now it is time for Korea to actively take legislative actions with regard to the obligations under the Convention which include: (i) to adopt a general policy which aims to integrate the protection of that heritage into comprehensive planning programmes, (ii) to foster the establishment or development of national or regional centres for training in the protection, conservation and presentation of the cultural and natural heritage and to encourage scientific research in this field, (iii) to give their help in the identification, protection, conservation and presentation of the cultural and natural heritage if the States on whose territory it is situated so request, and (iv) not to take any deliberate measures which might damage directly or indirectly the cultural and natural heritage situated on the territory of other States Parties to the Convention.
