In this paper I tried to explain to the status of the Provisional Government of Republic of Korea which was in China 1919~1945. If we will determine the status of the Provisional Government only from the legal criteria, it would be impossible to determine the status of it appropriately. Because the Provisional Government of ROK was a kind of imperium in imperio, while the law recognizes the right status of the persons and communities only within the boundary of a state. If we, therefore, will recognize the status of the Provisional Government of ROK, we must go beyond the boundary of state in general in order to open a wider horizon in which the Provisional Governmena of ROK can find the right topos of being. In this paper I suggest the `나라`(Nara) as the wider horizon for the Provisional Government. Because the states(국가) are the appearances of `Nara`, a state must be overcome by a new state. The provisional government is the seed of the new state which grows in the existing state.
