The right to housing protects people against the adverse effects caused by homelessness on their livelihoods and well-being. Therefore, recognition and effective guarantee of this right is important to improved well-being, better livelihoods and in reinforcing the exercise of human rights. In this Article, I consider recent developments in implementing this right in South Africa, especially at the level of the Constitutional Court.
The South African Constitutional Court has made use of the reasonableness approach, the approach to competing interests and the meaningful engagement requirement in housing cases. I focus on particularly the meaningful engagement requirement. It is a very useful means of guaranteeing the right to housing while respecting the democratic legitimacy of political branches. Here I review the South African Constitutional Court cases, such as Olivia Road and Joe Slovo that have discussed the meaningful engagement requirement.
The meaningful engagement requirement has several important functions. It allows for democratic processes of consultation and dialogue in implementing housing rights and relieves the effects of a negative court ruling. Also, housing vulnerable groups can influence housing policies and priority setting respecting the provision of housing by government through meaningful engagement. Futhermore, it is related to fundamental norms of participation, an important aspect of democracy.
But a discussion of South African jurisprudence regarding the meaningful engagement reveals some issues to consider. First, when large numbers of people are affected by eviction, the engagement should start as early as possible. Second, a court ordering meaningful engagement have to specify the details in relation to the engagement. Third, there is a dire need for a minimum step necessary to help housing vulnerable groups, such as legal assistance.
