The slot charter operation became very common aspect in carriage of goods by sea in these days. However, the legal nature of the space charter has not been studied in Korean academic circles.Korean Commercial Code (hereinafter KCC) encompasses only bareboat charter-party, time charter-party, (voyage) charter party and a contract for the carriage of an individual thing. KCC does not stipulate the space charter. The legal nature of the space charter is required to be clarified in order to apply KCC for the legal matters involved in the space charter.The analysis of the several space charter-parties of the Korean shipping companies shows that the space charter is a hybrid of time charter and voyage charter. In the meantime the fact that the charterer in the space charter-party use a part of space in regular basis is similar to a contract of lease, the fact that the shipowner in the space charter-party undertakes a carriage of goods is similar to a contract of carriage. The space charterer may invoke limitation of liability both in the form of global limitation and package limitation schemes under KCC. Under KCC, the fund of the global limitation is calculated based on the gross tonnage of the involved vessel. The writer suggests that the global limitation fund of the space charter must be calculated based on the percentage of the space of the vessel allocated to the space charterer. Legal matters involved in the space charter tends not to be solved easily because of the absence of the special provisions on the space charter in the KCC and the difficulty of interpretation on the legal nature of the space charter.The writer emphasize that special articles for the space charter must be added in the KCC.
