Artificial intelligence refers to a computer system that implements human intelligence in a mechanical way, or a study of its implementation. In addition to the Big Data, it is also a field that is regarded as a powerful driving force of the Fourth Industrial Revolution. The development of artificial intelligence is basically a model of real human brain functioning and various attributes and behavior of human beings.
However, artificial intelligence is a ‘tool’ that is originally developed to replace manpower, and by its nature, personality is incompatible with its existence. However, if artificial intelligence is to replace manpower in a wide range of fields in the future, artificial intelligence is likely to become the subject of legal acts or facts that humans have already used. We consider whether there is a possibility that artificial intelligence will have juridical personality based on the current system, principle, and necessity in accordance with the reasoning that legal personality must be recognized in order for such act to be legally valid. Furthermore, I will consider the effect of the case where the legal personality of artificial intelligence is recognized and criticize it.
