The principle of equal pay for work of equal value to achieve equality of wage is a core principle of the law of human rights for workers. It has been guaranteed in various international instruments and lots of nation's acts.
In Korea, this principle is only stipulated in the Act on the Gender Equality in the Employment. But, this Act has not clear provisions on this principle yet. And Courts have been passive in appling this principle to cases relating to discrimination.
This paper suggested the significance and the applicable scope of this principle in Korea as follows:
The firstly, in case of estimating "work of equal value", it is considered not only the skill, effort, responsibility, and working condition that are required in performance of the duties but also the duration of work and work career. This is why most Korean companies have paid wages not on the basis of objective appraisal of jobs but on the length of service due to a seniority system.
The secondly, the participation of workers should be guaranteed in deciding to a standard or a method of estimating "work of equal value." Especially, female workers should take participation in it to avoid the gender discriminational evaluation.
The thirdly, this principle should not be applied by means of a
downward adjustment of wage.
The fourth, this principle should be applied to eliminate not only gender discrimination but also to the wage discrimination of part-time workers, foreign workers and disabled workers.
