Human genome research is providing knowledge of the human genetic information and is facilitating the new diagnostic technologies and treatments. But It can make some ethical or legal problems, like harm to genetic privacy, problems of genetic discrimination, and abortion. The legal community can no loger avoid confronting difficult ethical, moral and legal issues that human genetic thechnology and biotechnology present.
Today, all of the nation legislatures share the burden of defining the legal character of human tissue and DNA in an era marked by swift advances in genetic technology and biotechnology. Since the birth of clone sheep "Dolly," there have been efforts to legislate acts on Legislative. In result, the bill was enacted such as "the Bill for Human Bioethics and Biosafety of Human," by the congress, mainly focusing on the prohibition of human cloning.
However, the Bill has the lack of national standards and safeguards regulating DNA data. So currently one of the issues in the legislation is whether to enact at least individual acts covering DNA privacy.
The first issue is to protect the individual's genetic privacy and to prohibit the genetic discrimination. We are faced with new forms of discrimination in the differing importances attributed to the various stages and modes of manifestation of human life. But even the DNA data is qualitatively human, and thus worthy of respect and protection.
The second issue is to think, specifically one question that often arises is whether or not persons have property rights in their genetic material. If the property right exist, speculation arises as to what extent the rights may become the subject of legally enforceable agreement.
The third issue is to modify/enact to allow for expungement subsequent to reversal of conviction and criminal donor access to genetic material and information. Without these protections no substantial obstacles exit to prevent geneticists, laboratories or other entities from exploiting a person's genetic code without compensation or consent.
