This study aims to examine the preliminary stages of drafting the government structure for the Founding Constitution of the Republic of Korea. It particularly looks into the different opinions of, and power competition between the drafters of the Constitution in the process of formulating and revising the parliamentary or the presidential system for the basic government structure. Through this study, I will show, first, the way the drafters of the Constitution understood the political realities at that time and what influence such understanding had on the enactment of the Constitution; secondly, how the relationship between the factors of the political institution and the political personality influenced the creation of the Constitution. Thirdly, I will analyze the relationship between the presidential system-based Constitution and autocracy.
The key debate around electing members of the Drafters Selection Committee and the Drafting Committee for the Founding Constitution was about the principles of selecting representatives, or the ‘representation’ problem. The main controversy in the drafting and revising of the Constitution was over the form of government the Constitution would be based on. In reality, the difference regarding the preferability between the parliamentary system and the presidential system was derived from the power competition between the Korean Democratic Party and Syngman Rhee. Considering their claims for power, however, both sides justified their systems on ‘stability’ of the nation. Although the presidential system was eventually adopted as the form of government, the National Assembly again attempted to check the powers of the President by allowing the Cabinet (“State Council”) to decide policies and by putting a balance between the President and the Cabinet.
