Along with the increase of infrastructure investment, such as roads, railways, harbor and airport facilities, and residential and industrial estate development projects, implementing such public works in time has been emphasized recently.
However, land price and compensation money, caused aquisition and development, have been rising rapidly. From the late 1970s to now, the Korean government had introduced several anti speculation measures to cope with the rapidly rising land price continually. But land price begin to rise again recently. So stabilizing land market remains as an important agenda of land polices
The purpose of this study is two fold. One is evaluate Constitutional and legal principle about public compensation system. Another is suggest improvement of bond-based compensation system for stabilizing land market.
This study begin Chapter 1 with presenting general issues and problems concerning land expropriation and compensation, and outlines the purposes, scope and approach of this study.
Chapter 2 and 3 provides concrete compensation standard of related laws in above to pursue the Constitutional theory on land expropriation and compensation.
Chapter 4 presented the institutional problem of current land compensation system.
Chapter 5 suggests basic directions for revising the land expropriation and compensation Acts, above all, utilities improved bond-based compensation system.
Chapter 6 outlines policy implications, including both systematization of the related institution and based in bond-based compensation.
