People's property rights are guaranteed by the constitution of Republic of Korea. But, when needed for public needs it will be allowed to infringe on property rights by law. In this case this infringement is possible within the range of just compensation. The constitutional law makes a declaration ‘the principleof just compensation’. What the meaning of ‘the principle of just compensation’ is confronted with each other. In my opinion, 'the principle of just compensation' means perfect compensation. Namely in need of compensation, the State should compensate for the objective value and expended loss of the person who meet with the land expropriation. “Act on the Acquisition of Land, etc. for Public Works and the Compensation therefor”, which is the general law of land expropriation determins ‘the principle of market price compensation’ as a rule of compensation. But, this principle does not maintain by various current legal system. Therefore, we must improve this problems by revision of the current law for the Observation of the principle.
