Amongst the worldwide growing attention on the mental disorders caused by work duties, it is recently under discussion in Korea to acknowledging such disorders as work-related diseases.
Work-related mental disorders may be caused by a complex set of factors. They may arise either in the course of employment or in the combination of employment and non-employment factors. Seriousness of such disorders will also vary based on one's organic or non-organic disposition. Due to this complexity, The South Korea is so far yet to establish a concrete set of standards that judges work-related and non-work-related mental disorders. It is compared to its well-set standards on defining other disorders. None of the IACIA(The Industrial Accident Compensation and Insurance Act), the Enforcement Decree of IACIA, and the guidelines of the COMWEL(Korea Workers' Compensation and Welfare Service) ever specifies rules of judging work-related mental disorders. Against this backdrop, the only way to conclude one's mental disorder as work-related is to apply the legal principles of case law, as they are commonly used in proving other work-related diseases. Although, we need to establish a separate set of case law principles for mental disorders considering above-mentioned complexity and diversity.
When defining the work-related mental disorders, one may be faced with the burden of proof. Unlike other work-related diseases, it is hard to prove mental disorders either in a medical way or in legal terms. It is against the principle of social law if we have workers bear an excessive burden of proof. If this is the case, mitigation of the burden or shifting of such burden needs to be considered.
In sum, it is recommended to introduce a set of standards or, at the minimum, to apply the legal principles of case law in defining work-related and non-work-related mental disorders, with supportive measures to reduce a worker's burden of proof. In-depth case studies and research will underpin such precedent-setting process.
