The purpose of this paper is critically to examine the range and ingenuity of the various devices adopted by the judiciary to extend the protection afforded by the terms of contract of carriage to litigants(third parties), who were clearly not parties to it. The common law doctrine of privity of contract has been a perennial source of difficulty for litigants seeking to enforce rights and obligations arising under a bill of lading contract. When carriage contract is negotiated, the concerned parties will be aware that some portion of obligations arising from that contract will be delegated to and performed by the employees of the carrier or independent contractors engaged to carry out a particular function.
In such circumstances, it is reasonable for the employees or the independent contractors to be allowed the benefit of the carrier under the contract of carriage, particularly, from the viewpoint of policy and justice.
The basic and actual problem is to find a way to permit the third parties who are neither agents nor servants to limit there liability; specifically, to find a way to allow stevedores and terminal operators, whom the carrier did not declare as his agents or servants but independents contractors, to nevertheless extend the benefit arising from the contract of carriage.
At least the protection afforded by the contract of carriage should be extended to cover all those who, in the normal commercial process, might reasonably be expected to be involved in its performance, unless their participation is expressly excluded by the terms of the contract itself.
